By accessing or using Demix ("Service"), operated at trydemix.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Demix is an AI-powered audio stem separation service that allows users to extract individual sound components (stems) from audio files using natural language descriptions. The Service processes audio files using machine learning models to isolate specific sounds such as vocals, drums, bass, guitars, and other instruments.

3. User Accounts

To access certain features of the Service, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use Demix only for lawful purposes. You must NOT:

• Upload audio files that you do not have the right to use or process
• Use the Service to infringe on any copyright, trademark, or other intellectual property rights
• Upload malicious files, malware, or any content intended to harm our systems
• Attempt to reverse engineer, decompile, or extract our AI models
• Use automated systems to access the Service in a manner that exceeds reasonable use
• Resell, redistribute, or commercialize access to the Service without authorization
• Use the Service for any illegal activity

5. Intellectual Property & Content Rights

Your Content

You retain all rights to the audio files you upload and the stems you create. By uploading content, you grant us a limited, non-exclusive license to process your files solely for the purpose of providing the Service.

Our Service

The Demix service, including our website, AI models, algorithms, and branding, are owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works based on our Service.

Copyright Compliance

You are solely responsible for ensuring you have the necessary rights to process any audio content. Demix is a tool—how you use the extracted stems must comply with applicable copyright laws and licensing agreements.

6. Payments, Subscriptions & Refunds

Certain features of Demix require payment. By purchasing credits or a subscription:

• You agree to pay all fees associated with your selected plan
• Payments are processed securely through Stripe
• We reserve the right to modify pricing with reasonable notice

Refund Policy

Credits and one-time purchases are non-refundable except as required by applicable law. We do not offer partial refunds for unused credits.

Cancellation

Subscriptions renew automatically unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us at trydemix@gmail.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. No partial refunds are provided for the remaining portion of a billing period.

7. Free Trial & Guest Usage

We may offer free trials or guest access with limited features. These are subject to fair use limitations and may be modified or discontinued at any time. Abuse of free trials (e.g., creating multiple accounts) may result in service restrictions.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS. AI-BASED AUDIO SEPARATION MAY NOT BE PERFECT AND RESULTS MAY VARY DEPENDING ON THE INPUT AUDIO.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEMIX AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Demix and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. DMCA & Copyright Claims

We respect intellectual property rights and expect our users to do the same. If you believe that content available through our Service infringes your copyright, please send a DMCA takedown notice to our designated agent:

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
